District Court for the District of Columbia ruled that e-cigarettes did not meet the criteria for drug-delivery devices and therefore were exempt from regulation under the FFDCA. Product use during the initial 3-month study period was also similar in all 3 study arms, and relatively high. These findings are reassuring in that they suggest that the study results were unlikely to be affected by expectations.
Even e-cigarettes that claim to have no nicotine have been found to contain nicotine. While teen smoking has fallen by 80% over the past 20 years, a new generation is now at risk of becoming addicted to nicotine — and possibly at risk for other serious health problems — through e-cigarettes. More than 2.5 million U.S. middle and high school students are now using e-cigarettes, with nearly 85% of them using flavored products. Vaping has exploded into a national crisis, and tobacco companies are helping to fuel it by targeting kids with flavors such as gummy bear and cotton candy.
Both smoking and vaping involve heating a substance and inhaling the resulting fumes. With vaping, a device (typically a vape pen or a mod — an enhanced vape pen — that may look like a flash drive) heats up a liquid (called vape juice or e-liquid) until it turns into a vapor that you inhale. Electronic smoking devices or e-cigarettes are battery operated devices used to inhale a vaporized liquid solution that frequently contain nicotine, flavorings and other chemicals.
The devices, also known as vapes, can cause serious health implications, including contributing to detrimental inhalation patterns, and heightened risks for youth’s developing brains, according to medical researchers. While data indicate a substantial decline in traditional cigarette smoking among U.S. adolescents, the introduction of EVP use and their alarming increases have presented new challenges. The researchers believe that the data create clinical and public health challenges. As of August 1, 2019, this definition includes carrying or using an activated electronic delivery device, such as e-cigarettes or vapes.
These cigarette data briefs provide estimates of cigarette sales in the U.S. market overall and select U.S. states. Since 2014, e-cigarettes have been the most commonly used tobacco product among U.S. youth. But, Blaha says, interpreting the data is tricky, since young people change their preferences often, and, when surveyed, may not consider using disposable products such as “puff bars” as vaping. The same CDC report says disposable e-cigarette use has increased 1,000% among high school students and 400% among middle school students since 2019.
However, because the youth e-cigarette epidemic in the United States and the youth appeal of flavored e-cigarettes go hand in hand, Truth Initiative strongly supports removing all flavored e-cigarettes from the market, regardless of device type. At a minimum, an e-cigarette manufacturer must show that the flavor itself is safe, helps smokers switch completely from combustible cigarettes, and does not attract youth before a product is allowed to go to market. In addition to flavor restrictions, Truth Initiative supports strong regulations to keep all tobacco products, including e-cigarettes, away from youth. More recent studies have suggested that young e-cigarette users are four times more likely to begin smoking cigarettes compared to their peers who do not use e-cigarettes. E-cigarette use has increased in recent years, especially among youth and young adults, who use e-cigarettes more than any other age group.
Additionally, when e-cigarette device owners were asked about e-cigarette waste disposal, the majority (73.7%) believed that it was difficult to find e-cigarette drop off sites. Results of the study, published online ahead of print in the peer-reviewed Ochsner Journal, show alarming statistically significant and clinically important increases of the daily use of EVPs in U.S. adolescents. As for evidence, there is what’s in the literature and then there is what’s in the applications that come in.

The most recent evidence suggests that e-cigarettes may pose their own unique health harms and that comparison to cigarettes may not be the only relevant question for determining their impact on individual health. Indeed, the growing evidence of potential health risks related to e-cigarette use has led some researchers to question whether e-cigarettes are safer than combustible cigarettes. While their manufacturers say they are an alternative for tobacco smokers who want to avoid inhaling smoke, critics say too little is known about the safety of ESDs because they are not regulated. E-cigarettes are sometimes called e-cigs, vapes, e-hookahs, vape pens and electronic nicotine delivery systems (ENDS).
Beginning smoking, switching to smoking, or reverting to smoking exposes the user to potentially devastating health effects. E-cigarette, battery-operated device modeled after regular cigarettes. ENDS may be manufactured to look like conventional combusted cigarettes, cigars, or pipes. Larger devices, such as tank systems or mods, bear little or no resemblance to cigarettes.
All adults who smoke conventional cigarettes or other combustible (burned) tobacco products should be advised to quit smoking at the earliest opportunity, recognizing that quitting is hard and often takes repeated, dedicated efforts. Individuals can also seek cessation support by calling QUIT-NOW or ACS-2345. Middle and high school students are the largest users of these smoking replacements. Recent youth tobacco surveys found e-cigarette use had surpassed conventional cigarettes as the most commonly used tobacco product among youth. These surveys also revealed that many young people consider vaping to be safe and are not aware that e-cigarettes contain nicotine. It is easy for middle school and high school students to conceal their use of vaping devices because of their appearance as everyday objects.
A user inhales the vapor, which is why using an e-cigarette is often called vaping. Most vapes contain high levels of nicotine (synthetic and tobacco derived), which is very addictive, impacts youth and young adult brain development, can lead to increased stress or mood disorders, and can lead to cigarette smoking or other drug addictions over time. Proponents of e-cigarettes claim they’re safer than smoking because they don’t contain the more than 60 cancer-causing chemicals in tobacco smoke and are not combustible. But e-cigs still deliver harmful chemicals, including nicotine, the extremely addictive substance in cigarettes.
For use frequency pre-ban, respondents reported whether they used e-cigarettes daily (every day or most days in a week ) or weekly (at least once a week, but not most days). For post-ban, respondents reported whether they used e-cigarettes daily, weekly, less than weekly, or not at all. For both pre- and post-ban, respondents reported all e-cigarette flavors they used, the flavor that they primarily used, and the different ways they obtained e-cigarettes. Most respondents continued to use e-cigarettes with banned flavors post-ban. Compliance of local retailers with the ban was not high, and many respondents obtained banned-flavor e-cigarettes through legal channels. However, the significant increase in the use of non-flavored e-cigarettes post-ban suggests that these may serve as a viable alternative among those who used previously used banned or tobacco flavors.
A 2019 study in the journal Addiction estimated that vaping may have helped as many as 70,000 smokers in the United Kingdom kick the habit. But the authors warned that cultural differences may prevent the results from being repeated elsewhere. Juul announced in October 2019 that it would eliminate all fruity flavors for sale in the United States.
E-cigarettes are nicotine-based products, and no nicotine use is safe. Until we know more, it is probably best to avoid these products whenever possible, including secondhand smoke. However, vaping early on may increase the chances of smoking ordinary cigarettes later in life.
Additionally, high quality epidemiology studies consistently demonstrate that e-cigarettes use increases conventional cigarette uptake, particularly among non-smoking youth, by nearly 3 times. Evidence reveals that these products are harmful to health and are not safe. However, it is too early to provide a clear answer on the long-term impact of using them or being exposed to them.
Recently, a study observed more than 6,000 teenagers between the ages of 12 and 15 to determine if e-cigarettes are increasing the odds for teen smoking. The 966 respondents who had never vaped more often believed that e-cigarette waste was dangerous to throw in trash compared to the 1,083 respondents who had vaped at least once (81.4% vs. 71%). Fewer of those who had vaped at least once (79.3%) believed that e-cigarettes contained toxic substances compared to those who had never vaped (89.6%). And the burden is 100% on the company, by law, to demonstrate that the marketing of their product is appropriate for the protection of the public health. In response to the burgeoning e-cigarette market and concern over youth using the products, the FDA in 2020 ordered most flavored vape pods off the market.

Of great concern are the wide range of e-cigarette candy-flavors that appeal to youth. While studies have shown that e-cigarette aerosol is less harmful than traditional tobacco smoke, that does not mean that it is safe.
The Department has sent a statewide health alert to health care providers and local health departments following recent reports of severe lung disease in people who have used vaping products. The cytotoxic and pro-inflammatory effects of different e-cigarette flavouring chemicals were also tested on two human monocytic cell lines—mono mac 6 (MM6) and U937 [86]. Among the flavouring chemicals tested, CAD was found to be the most toxic and O-vanillin and pentanedione also showed significant cytotoxicity; by contrast, acetoin, diacetyl, maltol, and coumarin did not show any toxicity at the concentrations assayed (10–1000 µM). Of interest, a higher toxicity was evident when combinations of different flavours or mixed equal proportions of e-liquids from 10 differently flavoured e-liquids were tested, suggesting that vaping a single flavour is less toxic than inhaling mixed flavours [86]. That’s why the Surgeon General’s Report calls on parents, teachers, health providers, the government, and communities to educate young people about and discourage the use of e-cigarettes. For those wishing to argue that “vaping” is safer than smoking and an effective way to quit, the Center for Disease Control (CDC), the surgeon general’s office, public health groups, and others point to the evidence disputing such a claim. Respondents who perceived a lower level of local retailers’ compliance to the ban were more likely to obtain e-cigarettes from illegal sellers and mixed flavored e-liquids on their own, compared with those who perceived a higher level of local retailer compliance. A possible explanation is the neighborhood effect, that is, in neighborhoods where law enforcement is relatively weak, local retailers are less likely to follow the ban and illegal sellers are more active.
In 2019, nearly 28 percent of high-school students and 11 percent of middle-school students reported using e-cigarettes. About 8 percent of young adults ages 18 to 24 reported using e-cigarettes in 2018. That’s why California has spearheaded progressive tobacco control policies – not only with SB 793, but through local sales restrictions in dozens of California cities.
E-cigarettes are considered tobacco products because most of them contain nicotine, which comes from tobacco. The FDA reported earlier this year that 1.3 million more high school students use e-cigarettes now than in 2017. Although the FDA began regulating e-cigarettes and other tobacco products in August 2016, there has been a significant spike in their use.
They have to give us all the chemistry and toxicology data, and they have to identify what’s in the product, including the liquid and the aerosol it generates. We can also do physical inspections of their manufacturing facilities, or remote records inspections, to verify the information in an application. We were prepared both operationally and from a scientific review standpoint.
Never smokers and former smokers were more likely to quit e-cigarettes. While there were no significant differences in quitting all e-cigarette use after each of the three state bans, e-cigarette users in New York were less likely to use banned flavors after the ban than those in New Jersey. The use of menthol flavor was also higher among smokers than former and never smokers. The percent of non-TM flavors had a reverse pattern, being lowest among daily smokers (46.7%), higher progressively along with those smoked weekly or less, former smokers, and highest among never smokers (79.1%). After the ban, the percentages of e-cigarette users who primarily used tobacco, menthol, and non-TM flavors decreased generally except the menthol share among never smokers did not change. After the ban, the percentage of those who quit using e-cigarettes was highest among never smokers (23.1%) and former smokers (13.5%) compared with 3.2% and 7.8% among those who smoked daily and weekly, respectively.
This may, at least in part, be due to ingredients of vape products, including vitamin E acetate, flavorings, and other additives. Flavors and other ingredients may combine to form harmful chemicals when heated. In addition to vitamin E acetate, several non-marijuana-based ingredients you inhale can harm your lungs. Some experts say chest X-rays of people with EVALI show signs of lung irritation by oily chemicals, which could include both vitamin E acetate and THC oil itself. Marijuana vaporizers are typically pen-like devices with an opening to inhale the vapor from tetrahydrocannabinol (THC) oils, or to use marijuana concentrates made from parts of the cannabis plant that contain high THC levels.
There is a web of policy approaches to these issues at all levels of government, including the federal, state, local and international level. While some evidence supports the use of e-cigarettes as quit devices, recent research suggests that their efficacy for quitting is likely overstated. Truth Initiative is America’s largest nonprofit public health organization committed to making tobacco use and nicotine addiction a thing of the past. This includes owners of vehicles from which e-cigarette products are sold and any person who sells e-cigarettes on the internet or by telephone or mail order.
Principal investigator Wendy Max, PhD, director of the Institute for Health & Aging, noted that from 2013 to 2018, e-cigarette use among high school students soared from 4.5% to 20.8%. Protective factors may reduce the risk of youth engaging in substance use. Increasing protective factors in addition to reducing risk factors can be more effective in preventing substance use. Only 28% of young people in the U.S. believe e-cigarettes have the potential to cause a lot of harm. Up to 40% of teens who vape are unaware their e-cigarette cartridges contain nicotine. Adults who use tobacco and are trying to quit should use proven quit tools, like group or phone counseling, paired with medications or nicotine replacement therapy patches, gum or lozenges.
E-cigarette use has increased 78 percent in one year for high schoolers and 48 percent in middle schoolers. Additionally, the CDC reports nearly 38 percent of all high schoolers and even 13 percent of middle schoolers have tried “vaping” at least once, and those statistics likely are underreported. Drawn to the fruity flavor cartridges, or trying to wean from traditional tobacco products, or even to curtail hunger, many people believe e-cigarettes or “vaping” is safer than smoking cigarettes and simply not addictive. As shown in Table 1, the majority of the 1624 respondents were males (61.2%), young adults between 25 and 34 years old (56.9%), Whites (59.4%), and had at least a bachelor’s degree (66.8%). The majority of respondents had used e-cigarettes between two and five years (69.6%) and 79.8% had moderate or strong intentions to quit. The percent of respondents saying they used e-cigarettes because of the added flavors or for quitting smoking cigarettes were 54.4% and 36.6%, respectively.
Interestingly, there is a strong difference of opinion on e-cigarettes between countries. Whereas countries such as Brazil, Uruguay and India have banned the sale of e-cigarettes, others such as the United Kingdom support this device to quit smoking. The increasing number of adolescent users and reported deaths in the United States prompted the government to ban the sale of flavoured e-cigarettes in 2020.

The CDC’s Office on Smoking and Health (OSH) developed this presentation to educate youth on e-cigarettes, including the health risks, the factors that lead to e-cigarette use, and what youth can do to avoid all tobacco products, including e-cigarettes.
At minimum, this outbreak dramatically demonstrates the dangers of an unregulated market in inhaled substances with no premarket review for consumer safety. E-cigarettes are hooking a new generation on nicotine – putting millions of kids at risk and threatening decades of progress in reducing youth tobacco use. It’s a nationwide crisis of youth addiction, fueled by thousands of kid-friendly flavors and massive doses of nicotine.
However, FDA enforcement efforts have had little effect on reducing teen vaping, according to recent data. “Cytisinicline has been shown in clinical trials to be effective and safe to help adults stop smoking cigarettes. The results of this study indicate that it might also help people to quit vaping.” Most e-cigarettes contain nicotine, which is addictive and can harm brain development in youth, affect learning, lead to use of regular cigarettes and increase risk of addiction to other drugs, according to the Centers for Disease Control and Prevention.
E-cigarette vapour has been reported to contain up to 7×1011 free radicals per puff.10 Both nicotine-free and nicotine-containing condensate induced a significant increase in ROS release from our AMs, which may explain the induction of apoptosis in nicotine-free liquid. There was significantly greater ROS production in AMs treated with nicotine-containing condensate than in nicotine-free condensate, once again suggesting both nicotine dependent and independent mechanisms at work. The effects of ECVC with and without were ameliorated by NAC and PI3K inhibition. A Foundation-led study presented at the 2024 Society for Research on Nicotine and Tobacco annual meeting found that monthly e-cigarette sales in California declined by 41% after statewide restrictions on the sale of flavored tobacco products took effect. However, the report also noted that the tobacco industry continues to market products to offset these declines, including non-menthol cigarettes that contain other cooling chemicals.
Research published in 2019 indicated many e-cigarette brands, including the popular JUUL brand, were specifically designed to be as addictive as Marlboro cigarettes, leading a new generation to nicotine addiction. Recent studies indicate disposable e-cigarettes are linked to higher vape rates among teens in the U.S. Teens and young adults who use them are more likely to keep vaping and vape more frequently. Even with these caveats, these findings warrant urgent attention from state agencies to enforce the ban on flavored e-cigarette products in California.
The U.S. Preventive Services Task Force, a group of health experts that makes recommendations about preventive health care, has concluded that evidence is insufficient to recommend e-cigarettes for smoking cessation in adults, including pregnant women. Bacterial phagocytosis by macrophages is inhibited acutely by ECVC and the effects are attenuated by the anti-oxidant NAC, suggesting ROS and reactive aldehydes play a role in the effects of ECVC/nfECVC. ROS production in response to cigarette smoking (or smoke extract) has been implicated as a mediator of adverse effects,23 therefore we examined the possible utility of N-acetyl cysteine (NAC) treatment in reducing the harmful effects of ECVC in THP-1 macrophages. Both AM and THP-1 macrophages were used for these experiments due to the large number of experimental conditions and numbers of cells required.
Patients have reported high variability in substances/products they used in vaping, including both tobacco and tetrahydrocannabinol (THC) containing products as well as other products. Many e-cigarettes and vaping materials contain harmful or potentially harmful substances, and it is difficult to know what each individual product contains. In addition, the percentage of EVP use in 2021 was higher in whites (6.5%) than Blacks (3.1%), Asians (1.2%), and Hispanic/Latinos (3.4%) compared to 2015. Federal regulators have targeted flavored vape liquids to rein in underage sales and use. Early results from a national survey of teen tobacco and e-cig use show vaping among teens continued to rise well into 2019. The National Institute on Drug Abuse found 1 in 4 high school seniors had vaped nicotine products within the last month. For 10th graders, the rate was 1 in 5, and for 8th graders, it was 1 in 11.
But levels are usually low and generally far lower than in tobacco cigarettes. Some of the harmful substances emitted in secondhand e-cigarette aerosols are similar to those in secondhand tobacco smoke. However, more research is needed to fully understand emissions from e-cigarettes and their impact on human health.

In the United States, marketing e-cigs to teens may have helped hook more young people on nicotine and tobacco. The FDA has never approved an e-cigarette as a smoking cessation device. Studies into whether the devices help people quit smoking have yielded mixed results. When Juul first hit the market in 2015, its vape liquid contained much higher levels of nicotine than e-cigs that had already been on the market. Each Juul pod contains as much nicotine as 20 regular cigarettes, according to the Centers for Disease Control and Prevention.
